[News] The Appeal of C-JeS vs. Avex

[Appeal C vs A]

- The court hearing was yesterday, June 26.
- A has appealed the court decision that c won.
- In the original case, c is the plaintiff and a is the defendant. Since this is an appeal, the roles are reversed. a is the plaintiff and c is the defendant.
- Probability of the decision by the lower court to be overturned is low. If this appeal will be dismissed then it will be the end.

- Next court hearing is on August 7, 11 am. There was a new claim from A. (Note: they can have a claim but no additional evidence can be submitted.) Rebuttal from C will happen on Aug 7. So hopefully we'll have a decision by then. There is also a possibility of settlement.
- The claim made by A was always rebutted by C. It is possible that the settlement amount may increase.
- The claim was submitted in writing so it was not clear what exactly is the claim

Actually, there’s something that all of you didn’t know.

2 weeks before Hitachinaka’s concert was held…

There was a plan to give a notice of cancellation at that time.

What had happened? I couldn’t say it in one word…

I can’t write it in details now, but it was hopeless…the condition was very serious in which there’s no way but to cancel it.

As for me, on that Saturday, 2 weeks before the concert, I knew about the situation and was urgently called to write a business proposal.

For example, if anything suddenly occurred, at that time, an expert will be gathered and a third party body took form…

Please think of me from a standpoint of which a person that is involved in these type of matters.

Basically, I’m a third party. I am not a person related to the event.

※Also as I’ve written before, I am a person who does not want to be in a place of which I’m an interest to the three of them, so I’m involved with them with one condition-I am not being paid. There seems to be people, who think that I open the blog to sell 3Voices…but since I’m involved in the planning, my intention is for people to watch it.

But, if it sells well or if it sells badly, none of it has any benefit to me.

My sole motivation…is for people to be happy.

The noises at that time…If it’s possible, we would like to joke about the story of that time at café HYT (tn: HYT: Hayato) (If that kind of thing really does exist…but *laugh*)

And then, after the next three days…

Merely 10 more days before the concert, due to a big twist, the concert was confirmed reversely.

I started to watch from Disc 2.

The scene of which Jaejoong, meeting with a Japanese person-in-charge of the stage while holding the image illustration…

For me, it is a deeply moving scene.

Of course, it didn’t go exactly as according to the business plan. But if there’s no business plan, things wouldn’t progress.

When you watch Disc 2, you’ll understand that the three spoke out of various opinions.

That is very good.

To make this opinions come to life…The three of them positively speak up about their opinions…

A concert packed with their opinions…That is the most important thing.

The concert was only confirmed with a mere 10 days before THE day.

At that time too, there’s problem with buses…there’s problem with tickets…
At places that couldn’t be seen, there are a lot of fighting against the various hindrance…it was really difficult until the concert

Meanwhile, from that day onwards, with 10 days left, the three of them did their preparation for the heartfelt stage.

That repeated and repeated rehearsal video…

You can feel the earnestness that the three put into their concert, right?

The concert above all these noises…I, on that day, couldn’t stop my tears seeing all of you who continuously keep coming to the venue

Smile,smile,smile…I walked around the venue alone, and see the smile on each and every one of you.

All of you, coming to the faraway Hitachinaka with a lot of thoughts jamming your heart…
Wholeheartedly wanting to see the three of them…

And the three of them whom wholeheartedly wanting to see all of you, had overcome various difficulties for this

That was…the Hitachinaka-concert

For the sake of those who unfortunately couldn’t come on that day, I think it’s a good thing that this DVD came out.

It is a DVD, packed with the fans smile and the three’s smile…it is also a very precious record for me

"Ever since I was little, I like our country's rock music more than dance songs. I listened and sand to Kim Kyungho, NEXT, YB, Jo Janghyuk's songs. Since my sister is a huge fan of Seo Taiji, I also often sang along. I especially liked, 'Classroom Idea' and 'Dreaming of Balhae.'"


Kim Jaejoong of group, JYJ, transformed into a rocker. It's not the current popular style of rock, but Retro Rock, which was fashionable in the 1990s. Sometimes, it sounds like pop-rock, sometimes it sounds like J-rock (Japanese rock). Filled with rock and ballad, his solo album, "I," was released on the 16th, including 5 songs with 'Mine' as the title track. Recently, meeting at a cafe in Naesu-dong, Seoul, Jaejoong answered my question of whether he was aware of the prejudice against idols doing rock. "I tried to create music that even people who like rock would say that it sounded great."


This is not the first time Kim Jaejoong transformed into a rocker. He frequently showed affection for rock in his solo performances back in the TVXQ times. In 2008, he released a solo song in Japan which was the rock number, 'Maze.' He said, "Sometimes I would watch the DVD of myself singing 'Maze' in Japan concert in 2012. The image of me enjoying the stage is very impressive."

Kim Bada of rock band Sinawi and Butterfly Effect composed 'One Kiss' and 'Mine.' Shaun of indie band, KOXX, also participated in the recording. Kim Jaejoong wrote the lyrics for most songs of the album and composed 2 of the songs. He said, "I don't know what everything would be like if I had made the album alone. The album is filled with good songs thanks to the participation of outstanding rock musicians." In order to assimilate rock music well, Jaejoong, with help of Kim Bada, abandoned his existing vocal delivery and attempted a shouting vocalism.

Kim Jaejoong's rocker challenge is, so far, progressing with half of the success. Although the album sales are constantly ranked #1, we couldn't say the same yet about the online music charts. As this is his new attempt, there must be some meaning in this. "As a member of JYJ, its a responsibility and also a burden to always show better and new things. Good opportunity came just in time. Not only fans, but there were many people waiting for my rock album." His fan meeting and concert held at KINTEX, Goyang, Gyeonggi, to celebrate the release of the new album, was a huge success with a total of 16,000 attendees.

The whole album is like a personal monologue by Kim Jaejoong. The album's title, and also 'Mine,' 'My Only Comfort,' 'All Alone' etc, the songs for which he wrote the lyrics, are all about, 'I.' "It was not intentional. When I put the songs together, it gave the feeling of something that only I could talk about. Maybe the director did research about my character. He made 'Mine' MV with that feeling. I did say a lot before that I thought I was the ugliest among the members. In the team, I was the one who received the most clear and heavy likes and dislikes toward my appearance. Then in the MV, I appeared as a lonely man wearing a bejeweled mask. I think the music and the video represented really well my hard times in the past."

The 3 year legal dispute between JYJ and former agency SM Entertainment has come to an end. They also won over the Japanese agency, Avex. I asked about his feeling of being freed. He said, "Maybe because it was a very long and tough time, my heart was so touched." "Since we just kind of escaped from a frustrating situation, I hope that we will be able to show ourselves as JYJ in another capacity."

Jaejoong reveals his wish to meet with Japanese fans as part of JYJ first rather than a solo artist



JYJ‘s Jaejoong, who commented that he’d like to start performing again in Japan, after winning their lawsuit against Avex, specified that rather than meeting his Japanese fans first as a solo artist, he’d want to wait to do so with his members.

When asked during a press conference, “Can’t you, Jaejoong, be the one to start activities in Japan first?”, Jaejoong replied, “Personally, I would like all three of us to do it together. Whether it’s a concert or broadcast, at least for the fans in Japan who faithfully waited four years, we want to show ourselves as the three of us together. How much must they have endured? In a recent interview held at a coffee shop in Gwanghwamun, Kim Jaejoong opened up about plans after winning the case against AVEX.

Kim Jaejoong answered, “First of all, I hope to quickly go to Japan and meet everyone with a concert.” He continued, “after that, if I can get a distribution channel and gain freedom, I want to formally release a Japanese album in Japan. If I’m free like the result of the lawsuit says, I should be able to go on broadcasts as well. It would be nice if this happens,” revealing his anticipation for activities in Japan.

At the question of whether Kim Jaejoong forgot his Japanese due to the halt on his Japanese actitivies, Jaejoong replied with a smile, “Everyone doesn’t know this but I’m using Japanese a lot.” When asked about the other members’ Japanese skills, Kim Jaejoong cutely said, “Aside from Junsu, we’re doing okay. (Seoul Union News) On the 18th, Seoul District Court sentenced an order to AVEX, management agent of Korea’s popular group JYJ in Japan, to prohibit the agent’s right to monopolize the management of JYJ in the country (Japan). AVEX was also ordered to pay 660 million yen (7.36 million USD) as reparation to JYJ’s Korean management company, C-JeS.

In addition, AVEX must pay 1 million yen (11,000 USD) as damages to the representative of C-JeS for defamation charges.

The side from C-JeS commented, “Japanese Court’s acknowledgement of the interference of AVEX in JYJ’s activities in Japan, and ruling to prohibit such actions, made us very happy. With this ruling, JYJ hopes to resume their activities in Japan as soon as possible.”

While they were involved in the lawsuit with former Korean management agent SM Entertainment, JYJ signed a management contract with AVEX via C-JeS in Feb 2010. However, when AVEX disagreed with C-JeS on the scope of JYJ’s activities, AVEX began to claim that the representative of C-JeS was linked with doubtful groups (mafia, gangsters) and one-sidedly terminated all JYJ’s activities in Japan in September 2010.

C-JeS requested for terminating the exclusive contract with AVEX but, AVEX insisted its right to the exclusivity of managing JYJ in Japan and rejected this request.

JYJ’s ‘The JYJ’ Magazine Set for Simultaneous Release in Korea and Japan



JYJ is preparing to release the first edition of its magazine, The JYJ.

Created to commemorate JYJ’s 1000 days since the group’s formation, the magazine will feature new images, interviews and other goods from their world tour to their solo activities in musicals and dramas.

The magazine’s release also comes as the group and its agency recently reached an agreement with JYJ’s former agency, SM Entertainment, and also won its lawsuit against its Japanese agency, Avex.

C-Jes Entertainment shared the upcoming release of the magazine is all the more meaningful after the many setbacks and difficulties the group faced during the past few years. The agency also felt the magazine would hold special meaning for the many fans who have still supported and loved the JYJ members all the years.

The JYJ members spent over 25 hours being interviewed for the 139-page magazine and special DVD.

The members candidly shared on their difficult periods, the special people who provided the strength and courage for them during that time and other personal topics.

The JYJ members said about the magazine, “Looking back on our 1000 days, there were a lot of hard times but we can also say we were truly happy. Though there were things that we didn’t foresee, it allowed us to work harder and improve. We want to share that happiness we felt each morning and when we went to sleep every night during these 1000 days with our fans.”

The magazine will be released simultaneously in Korea and Japan in early February and can be purchased online through the C-Jes store homepage and the JYJ Japanese homepage.

With JYJ prevailing over the lawsuit, can they change the Hallyu landscape in Japan?

Idol group JYJ has prevailed over the lawsuit on the exclusivity contract filed against Avex Japan.

According to Tokyo District Court, Avex should suspend the act of claiming exclusive management of JYJ in Japan. The court ordered Avex to pay reparations amounting to 660 Million JPY to C-JeS, JYJ's management agency.

This ruling meant a lot for JYJ. When JYJ separated from TVXQ, they had to accept constraints on their activities due to various lawsuits. In November 2009, JYJ received an injunction for the suspension of their exclusive contract with SM. They signed an agreement in February 2010 with Avex and faced false rumors such as the C-JeS CEO being involved in an organized crime group.

Due to the litigation, they turned to dramas and musicals. The fact that they can't work in Japan was a major blow, despite having a considerable fanbase.

In fact, it is not unreasonable to say that TVXQ was used as the starting point of Hallyu wave in Japan. Currently, idol groups Kara, SNSD, Beast, and 2PM are gaining popularity in Japan, but they pale in comparison with TVXQ's popularity of the past in terms of depth and width of the fanbase.

With the court ruling, JYJ is expected to lead the recent Hallyu wave which has recently stagnated.

According to local sources, the Hallyu wave was reduced in comparison to before. The Dokdo dispute has contributed significantly to the decline of Hallyu.

Resumption of JYJ's activities in Japan is being viewed positively since they can target both music and drama markets. JYJ member, Park Yuchun, has solidified his position as an actor in his recent dramas.

Park Yuchun has increasingly been gaining popularity for starring in several dramas such as Rooftop Prince, Miss Ripley, and I Miss You. His first drama, Sungkyungkwan Scandal, was successful in Japan. This will also help in the resumption of their activities in Japan.

In prevailing over their lawsuits, fans are hopeful that it is the start of JYJ's full-fledged activities. It is noteworthy that their comeback could be a game-changer and can lead to structural changes in the future of the Hallyu wave in Japan.

C-JeS releases details regarding JYJ’s lawsuit victory over Avex + Avex announces its intentions to appeal



After the initial announcement regarding JYJ‘s win against Avex, C-JeS Entertainment has revealed details regarding the ruling received.

According to C-JeS, the Japanese court ruled that Avex cannot insist on JYJ’s sole management in Japan, and ordered the management company to pay JYJ’s agency C-JeS Entertainment 660 million Yen (~ 7.3 million USD). The court also acknowledged the fact that Avex has defamed C-JeS’s CEO, and as such, ruled that they also pay the CEO 1 million Yen (~ 11,000 USD).

To recap, JYJ and Avex ended their exclusive contract back in 2010 and as the conflict of promoting in Japan escalated between them, Avex had released a public notice that falsely claimed that C-JeS’s CEO was affiliated with gangsters and brought about the halt of promotions in Japan for the group. They also insisted that they had sole management over JYJ’s Japanese activities and interfered with the group’s attempt to put on a charity concert back in 2011, which led to the lawsuit.

In response to the ruling received in court today (18th), Avex has already made it clear through an announcement on their homepage that they cannot accept the decision and that they will be filing an appeal.

The group JYJ finally wins the lawsuit against its Japanese agency, AVEX.

On January 18, Tokyo District Court in Japan orders AVEX, Japan’s biggest management company, to stop engaging in acts such as claiming exclusive management rights to JYJ in Japan. The court also ordered AVEX to pay approximately 660 million JPY (approximately 7.8 billion KRW) as compensations for damages to C-JeS, JYJ’s agency.

Tokyo District Court acknowledged the fact that AVEX made announcements that defamed the CEO of C-JeS, and consequently ordered AVEX to also pay approximately 1 million JPY (approximately 1.1 million KRW) for compensations for damages to C-JeS’s CEO.

After the injunction against SM Entertainment to terminate the effects of exclusive contract, JYJ signed an exclusive contract with AVEX through its agency, C-JeS. When the two parties came into conflict regarding the range of activities, AVEX suspended JYJ’s activities in Japan arbitrarily through a unilateral notification, making false claims about the CEO of C-JeS’s connections to gangs.

In response, C-JeS notified AVEX on the termination of the exclusive contract with AVEX to continue [JYJ’s] activities in Japan, but AVEX has been interfering with JYJ’s activities such as concerts and claiming exclusive management rights to JYJ in Japan. Consequently, C-JeS filed a request for prohibition of interference and claims for damages and received the judgments as described above on the 18th.

C-JeS commented, “We are very pleased that the Japanese judiciary has acknowledged and prohibited the interferences of AVEX against JYJ’s activities in Japan.” Also, C-JeS expects to resume JYJ’s activities in Japan based on this ruling.

JYJ has completed all legal lawsuits and they have been set free with this ruling, following the settlement of the 3 years and 4 months-long exclusive contract dispute with the former agency, SM Entertainment, in November, 2012.

JYJ Wins the Case: Regaining Freedom from Avex and SM's Vicious Connection

SM and Avex, all efforts to paralyze JYJ have ended in vain. The textbook example of the tyranny of vicious entertainment firms, SM and Avex must not continue their predatory behavior according to the judgment.

SM and Avex have behaved as a powerhouse based on their capital power, which was clearly exposed during the lawsuit with JYJ. Like gangsters, they have controlled the mass media, enfettered their entertainers, and, if those entertainers don't act as they demand, they then try to sink those entertainers down deeply. All these things are now known to most. Their malicious and mean behavior, frankly, speaks volumes about greedy large entertainment firms.


JYJ Thwarts Cruel Attacks from SM and Avex


Pointing out SM's problems and getting out from it, JYJ have been through hard times. It was out of great courage to point out the long-term contract, or so-called, Slavery Contract. This historic action by top group, TVXQ, served as an opportunity for the Korean entertainment industry to correct its absurdity and irrationality. In this sense, JYJ deserves praises.

Against SM, who made a contract that gave thoroughly disproportionately high advantages to the firm, JYJ has challenged to lead the contract into a more rational way for more than 3 years. And JYJ has been driven into a situation in which the group is unable to appear on TV. They [SM] were not only putting restrictions on TV activities but also criticizing and maliciously disturbing JYJ. Their behaviors were dirty and shocking.

If it had not been for JYJ and their fans power, it would have been rarely possible to gain a winning from large firms like SM. Myriads of fans have been firmly supporting JYJ. Thus, JYJ has gained courage from their fans support and has astoundingly paved their own way without bending their knees.

Performing excellently in dramas and musicals, JYJ has enlarged their potential not only through domestic, but through overseas tours. JYJ's hardship paradoxically served as a chance to pioneer a new market. JYJ's struggle eventually made SM succumb. The mighty firm has even acted as if it was above the law. Mobilizing interest groups in favor of the firms, pressing the broadcast companies, and exausting every means to drive out JYJ, the cruel firms came to not be able to stand any longer.

JYJ even gave up profits from its activities in Japan and continued the lawsuit, and the lawsuit ended in total favor of JYJ. Until the very last moment, the firm showed their greed for money, raising criticism from the public. JYJ utterly gained victory through consent by giving up money with ridicule on the firm who can't give up its greed for enormous profits from Japan.

SM's Japanese partner, Avex has no difference from SM. JYJ found it hard to appear on TV or perform a concert due to pressure from the two powerhouses in Korea and Japan, but now the group's victory in Japan's court will lift restrictions.

"We received short news of winning the case at 2 PM from our Japanese attorney. We're waiting for more details about the judgment."

After prolonged litigation, the result was JYJ's victory in Japan. It is surprising that the group won the case in a foreign country since it was really difficult even in its own country. For the Japanese, it is more worthy because the court ruled that the foreigners, JYJ, were treated unfairly.

On January 19, the Tokyo District Court ordered Avex not to claim exclusive management rights for JYJ in Japan. In addition, the court ruled that Avex should pay reparations of 660 million yen (7.8 billion won) to C-JeS Entertainment and 1 million yen(11 million won) to chief of C-JeS.

As we can learn from the reparations worth a whopping 7.8 billion won, Avex in connection with SM has gone to all lengths to kill JYJ but ended up in a shameful situation. The naked truth of evil deeds by the entertainment firm, with considerable influence in Japan, was revealed in the court.

"There were 4 cases in process between Avex and C-JeS Entertainment over Avex' artists Junsu/Jejung/Yuchun (JYJ). Today, on January 18 in 2013, the Tokyo District Court ruled on the 4 cases. Avex is protesting against the ruling and appealing against it. "

Avex made a decision to immediately appeal against the Japanese court's ruling. Furthermore, Avex still insists that the members of JYJ belong to them. Once evilly trampling on JYJ in order to disturb JYJ's activity, Avex, now stuck in the mire, is shamefully insisting that JYJ belongs to them.

In Korea, SM had maliciously prolonged the lawsuit in order to avoid paying settlement money and Avex is showing the same dirty step. Avex must pay reparations worth 7.8 billion won. So, to therefore not pay the reparations, Avex is highly likely to try and prolong the lawsuit as SM did.

JYJ is now set free both in Korea and Japan. There's no reason to endure tyranny of large entertainment firms. True, there remain possibilities that invisible hands will exert their influence to oppress the group. Yet, JYJ is now legally free and has more various ways to reach their fans.

JYJ has met its fans in a variety of ways such as solo albums, and, now the time has come to begin their activities in the name of JYJ for numerous fans waiting for JYJ in Korea and Japan. In the age of oppression, JYJ risked everything to correct absurd practices and finally won - this is very meaningful since JYJ's victory will prevent further similar errors in the future. Avex Management Group (AMG), a wholly owned subsidiary of the company who, together with C-JES Entertainment Co. Ltd, have exclusive rights of artists JUNSU/JEJUNG/YUCHUN have received today the ruling of the Tokyo District Court in respect of the following four lawsuits:

1. Tokyo District Courts 2011 No. 17612 Injunction against defamatory actions
2. Tokyo District Courts 2011 No. 20390 Request for compensation against damages
3. Tokyo District Courts 2011 No. 25447 Request for compensation against damages
4. Tokyo District Courts 2012 No. 8301 Request for compensation against damages

AMG has decided to appeal the ruling to the Tokyo High Court as soon as possible.

Lawsuit results of claims for damages between AVEX and C-JeS:

- Avex must not interfere with activity of JYJ in Japan. The company cannot issue demands or exercise orders concerning exclusive management rights in Japan. The court rules that AVEX has no right to distribute documents or notifications (in writing or orally) that claims C-JeS is violating AVEX's rights by allowing the 3 members of JYJ to carry out their entertainment activities (such as concerts) without AVEX.


  • The contract does not exist.
  • Indemnification / Damages: Avex must pay 600 million JPY to C-JeS

Avex – defendant
C-JeS – plaintiff

1) Avex should not circulate any documents or verbal notice to any 3rd party in case JYJ Kim Jaejoong, Kim Junsu, and Park Yoochun hold activities in Japan since they do not hold exclusive rights to manage JYJ in Japan.

2) Avex will pay c-jes, 665,957,108 JPY (~7.4 M USD) as compensation for damages. Computation starts from August 2011 until present and with interests.

3) Avex will pay 1,000,000 JPY to Baek Changu for defamatory action.

4) All lawsuits are dismissed.

5)For Court costs throughout the whole trial, cjes will pay 3/5, Baek will pay 1/5 of c-jes’ 3/5, Avex will 2/5 as well as pay for costs of Sumo Association.

JYJ Wins a Lawsuit against AVEX on JAN 18

Korean Source: JYJ, 日 활동 길 열렸다. 18일 재판서 Avex에 승소

JYJ’s activities in Japan seemingly to resume as last.

“The ruling of the lawsuit on JAN 18, decided AVEX cannot interfere in JYJ’s activities in Japan,” now confirmed by C-JeS Entertainment, the management company of JYJ.

It also added, “As soon as the full written judgement is received, we will release official press release”.

JYJ filed a lawsuit against AVEX, claiming AVEX interfered in JYJ’s Charity Concert to help Japanese Earthquake victims in 2011 [2011 JYJ Unforgettable Live in Japan].

With this ruling in Japan, it is expected that JYJ might resume activities in Japan where the group has high popularity.

Finally Winning The Lawsuit!


This is the article that I couldn't stop myself from writing.

With this, the three of them can spread their wings freely in Japan.

The 3 years which the three of them had to vainly shunned away was unbelievably long.

But the three of them didn’t let it go to waste.

And, they didn’t lose the spirit and decided to not be defeated and carried on with that energy, which was because of the solid bond and support that the fans are giving to them.

I, would like to sincerely congratulate you (T/N:fans).

And of course, thank you.
